Terms of Service

1. Subject

These Terms of Service ("Terms") govern access to and use of the titop.ai SaaS service (the "Service") provided by Mercurix Sàrl, Rue de Berne 58, c/o Semsa Salihbegovic, 1201 Geneva, Switzerland, UID CHE-444.410.641 ("we").

2. Acceptance

By creating an account or using the Service, you accept these Terms. If you act on behalf of a company, you warrant that you have authority to bind it. The Service is intended exclusively for business customers (B2B).

3. Account and Access

You must provide accurate information when creating your account. You are responsible for keeping your credentials confidential and for all activity under your account.

4. Plans and Billing

Current plans and pricing at titop.ai/en/pricing. Monthly or annual billing, charged in advance via Stripe. All prices in CHF, excluding VAT. 30-day money-back guarantee on paid plans. The Free tier requires no credit card.

5. Acceptable Use

You agree not to:

  • Use the Service for illegal or fraudulent activities;
  • Attempt to bypass security or rate-limiting measures;
  • Reverse-engineer, copy, or redistribute the Service;
  • Send spam, malicious content, or content infringing third-party rights;
  • Overload the infrastructure (technical rate limits apply).

6. Intellectual Property

The Service, its code, its interfaces, and its AI models are the exclusive property of Mercurix Sàrl and its licensors. You retain full ownership of the data you process through the Service.

7. Data and Privacy

Processing of your personal data is governed by our Privacy Policy. As a processor under the GDPR for your contact/customer data, we sign a Data Processing Agreement (DPA) on request.

8. Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Planned maintenance will be announced reasonably in advance.

9. Limitation of Liability

To the fullest extent permitted by applicable law, our total liability under these Terms is limited to the amount you paid in the twelve (12) months preceding the event giving rise to the claim. Neither party is liable for indirect, consequential, or lost-profit damages.

10. Termination

You may terminate your subscription at any time from your account. We may suspend or terminate your access for material breach of these Terms with reasonable notice.

11. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Any dispute will be submitted to the competent courts of Geneva, subject to mandatory provisions of applicable law.

12. Changes

We may amend these Terms. Material changes will be notified to you by email with 30 days' notice. Continued use of the Service constitutes acceptance.
